US Customs and Border Protection Building New System for Tariff Refunds

DOWNERS GROVE, ILLINOIS (March 23, 2026) – NSGA is pleased to share an important development that can offer meaningful financial relief. In a recent decision, the US Supreme Court struck down the Liberation Day tariffs, ruling that the Administration exceeded its authority under the International Emergency Economic Powers Act (IEEPA), the statute originally invoked to justify the emergency use of these tariffs. The Court determined that IEEPA does not grant the power to impose tariffs of this nature, rendering the program invalid.

As a result of this ruling, importers are now eligible to request refunds for tariffs previously paid under the Liberation Day program.  It is our understanding that refunds will not be processed without using the refund portal as described below.

How to Begin the Refund Process

US Customs and Border Protection has opened the refund pathway where corporate or individual overpayment of customs duties, taxes, fees, and miscellaneous or invalid payments can now initiate their requests directly through the CBP Automated Clearinghouse (ACH) refund portal:

The site provides guidance on required documentation and step‑by‑step instructions to help you move through the process smoothly.
